The traditional real estate agent's role. Acting as your agent in the listing and sale of your property. We act as the agent of the seller (our client), owing the seller loyalty, obedience, confidentiality and disclosure within the limits of law and ethics. By law and our Code of Ethics, we owe the buyer (our customer) fair dealing, honesty and the disclosures required by law (such as material defects of the property). Our written agency agreement is the listing agreement signed by the seller or a subagency agreement with a cooperating broker.

We act as your agent in the purchase or lease of a property. As the agent of the buyer (our client) we owe the buyer loyalty, obedience, confidentiality and disclosure within the limits of law and ethics. We owe the seller (our customer) fair dealing, honesty and the disclosures required by law, such as a material limitation on the buyer's ability to perform the terms of the contract. Our written agency agreement is a buyer's representation agreement signed by the prospective purchasers of property.

We cannot legally act as a buyer's or seller's agent without a written agreement. It is the agreement which establishes whose agent we act as not the source of the fee. We can, and do, act as buyer's representatives with the fee paid at closing by the seller from the purchase price. For reasons relating to convenience and tradition many,if not most, buyer's agency transactions are handled in this
manner.
