Although strictly speaking, transaction brokerage is a nonagency service, it does involve the salesperson in a selling and not a consulting capacity. In fact, the transaction broker may provide information regarding a property, but may not provide advice to either party. Only an agent can provide advice in a sale situation. In transaction brokerage, the real estate salesperson acts as a facilitator, a neutral intermediary bringing buyer and seller together. The salesperson owes each party a duty of confidentiality to the extent allowed by law, but does not owe any duty of loyalty to either party (is not a fiduciary of either party). The transactional broker (or salesperson) has no duty to conduct an independent inspection of the property and is not held to as high a standard on property defects as an agent of buyer or seller.
An appraisal may cost you $200 or more and only tells your homes theoretical "market value."
